'Facts that mislead the court were presented'

SG Tushar Mehta argued on this matter that 'Yesterday kejriwal himself said in a press conference that he will surrender on the 2nd. His statement does not seem that he will surrender on his own will. He wants to take his chance in the court once. His statement is misleading. Hariharan has said on behalf of kejriwal that 'I am not properly aware of the statement. If the court does not give him relief, then he has no other option except surrender. SG Tushar Mehta further questioned that 'The facts presented in the petition by kejriwal are misleading, facts have been hidden. Lies have been told about health.' On this, ASG sv Raju said that 'Kejriwal's petition is not worth hearing. The sc order is clear that he has to surrender on june 2. There is no change in that.' ASG Raju again questioned that 'the bail kejriwal has got was from the SC. Now by asking for interim bail, he is in a way asking this court to extend the time period of interim bail set by the SC. kejriwal has not got interim bail from this Rouse Avenue Court. Then how can he ask for extension of the time period of bail granted by the sc here.'

Further ASG sv Raju said that 'SC had only given him the exemption that he can go to the lower court for regular bail, but this does not mean that he started asking for interim bail here. His demand for interim bail of 7 days is not worth hearing. Any court hears the interim or regular bail application of an accused only when the accused is already in custody, but here kejriwal is not in custody, he is already out on bail. In such a situation, none of his applications are worth hearing at this stage. He cannot get the interim bail granted by the sc extended from this court. The provision of double condition of bail under section 45 of PMLA also applies to interim bail. Kejriwal's application does not mention that a demand for extension of interim bail was also made to the SC. The information about the stand of the sc on that has not been given in the petition. This is hiding the facts.' SG Tushar Mehta said that 'When the sc has already made it clear that kejriwal has to surrender on june 2, then can this court change that order. He had also sought extension of interim bail from the sc, but the court had rejected it.' SG Tushar Mehta further said that 'Instead of getting a medical checkup done, Arvind Arvind was continuously holding public meetings and road shows. This clearly means that he is not ill. The claim of losing 7 kg weight is false, rather the truth is that in the meantime, Kejriwal's weight had increased by one more kg.'
