Farmers Protest: Why did the Modi government take the "U-turn"?

When on november 26, the farmers end their 1-year protest, the farmers announced that they would further intensify the movement.

A day before Modi's announcement, amit shah was handed over the responsibility of the western Uttar Pradesh elections.

On the other hand, prime minister Narendra Modi made a statement on Guru Nanak Jayanti and surprised everyone. Now punjab is also a reason for the announcement.

What are the demands of the farmers?
The farmers demanded the repeal of these three laws. On november 19, 2021, prime minister Narendra Modi apologized to all the farmers of the country, announcing that these laws were being withdrawn.
However, farmers are demanding that they be legally guaranteed a minimum support price (MSP).
After the central government withdrew the laws, the farmer representatives led by the US Kisan Morcha held talks with the central government representatives on december 7 on the future course of action.
 

What are these laws?
Making some amendments to the Commodity Commodities Act, 1955. The Essential Commodities (Amendment) Act, 2020 was enacted to regulate the activities of the Center for the production, supply, distribution and trade of essential commodities. Competition in the sector, the Center said, was a law aimed at increasing farmers' incomes.
The main elements of this law

Control over food products: This Act empowers the central government to specify certain types of food items, fertilizers and petroleum products as daily necessities. The law gives the Center the power to regulate the supply of any food items such as cereals, pulses, potatoes, onions, oilseeds and oils in the event of extraordinary circumstances such as war, famine, skyrocketing prices and natural disasters.


Storage: The law also gives the center the power to regulate the amount of storage that a person can store of any essential item. This is based on the increase in prices. The decision is made by estimating the level of growth compared to the five-year average price or the one-year-old price.

 In the case of horticultural products, there is a possibility of imposing restrictions on storage if the price rises by 100 per cent. A 50 per cent increase in the price of non-perishable agricultural produce could lead to a restriction on storage.


However, this storage limit does not apply to value chain partners of the respective farm goods. 
That does not apply to anyone from the grower to the processing, packaging, warehouse, shipping, distributor. These restrictions and storage limits do not apply to the public distribution system.


Farmer Products Trade and business (Incentive, Facilitation) Act'

It allows for free trade between different states in the country and between districts within the states, regardless of the market committees that regulate agricultural markets. Neither the states nor the local governments can levy any taxes or fees on agricultural products sold beyond the boundaries of the market committees.


Electronic Trading: Allows electronic trading (e-commerce) of products under the control of the State Agricultural Market Committees in the specified trade area. An electronic trading platform can be set up for online trading. PAN card holders, partners, registered societies, farmer producer organizations, agricultural co-operatives can set up any such online trading platform.

'Farmers' (Empowerment, Protection) Price Guarantee, services contract Act-2020 contract Farming: The law allows the farmer and buyer to enter into an agreement before harvesting any agricultural produce. These contracts can be made for a minimum of one harvest to five years.Price of agricultural produce:



The price of agricultural produce should be specified in the contract. The pricing process should be written in the contract. Three-Tier Dispute Resolution Procedure: The three-tier system of conciliation board, sub-divisional magistrate and appellate authority are involved in resolving issues arising out of this contract form.

In case of any dispute .. first try to reconcile within the board. If there is no solution, the sub-divisional magistrate will be contacted within 30 days.
The Appellate Authority will be consulted against the decision of the Sub-Divisional Magistrate.


The Appellate Authority consists of IAS level officers.This law does not allow for the taking of agricultural land for recovery if a decision is made against the farmer at any level.
