In January, the US supreme court rejected Rana's petition and approved his extradition. Pakistani-origin Canadian citizen Rana (64) is currently kept in a metropolitan detention center in Los Angeles. Tahawwur Rana is close to Pakistani-American terrorist David Coleman Headley, one of the main conspirators of the 26/11 attacks. US President Donald Trump's administration approved Rana's extradition last month.


Mumbai terror attack accused Tahawwur Rana has made a new move after the supreme court rejected his petition requesting a stay on his extradition to India. He has filed a new petition before Chief Justice john Roberts. Pakistani-origin Canadian citizen (64) Rana is currently lodged in the Metropolitan Detention Center in Los Angeles.

On february 27, 26/11 attack accused Tahawwur Rana had submitted an emergency application before the Associate Justice of the US supreme court and Circuit Justice Elena Kagan of the Ninth Circuit to stay the pending trial of the habeas corpus petition. A note published on the website of the apex court on march 6 said, "The application ... Justice Kagan rejected it." According to the application filed by Rana's lawyers on Thursday, Tahawwur Rana has now renewed his emergency application to stay the pending trial of the habeas corpus petition presented before Justice Kagan earlier. In such a situation, it is requested that the renewed application be presented before Chief Justice Roberts. In his earlier application, Tahawwur Rana had sought a stay on his extradition and surrender to india till the trial is pending on the merits of the february 13 petition. In the petition, Rana argued that his extradition to india is a violation of US law and the United Nations Convention against Torture, as there are sufficient grounds to believe that the petitioner will be at risk of torture if he is extradited to India.


The petition said, 'The possibility of torture in the case is even more, as the petitioner is a Muslim of Pakistani origin accused in the mumbai attacks.' The petition also said that due to his serious medical condition, extraditing him to indian detention centers is a de facto death sentence in this case. In January, the US supreme court rejected Rana's petition and approved his extradition.
