Good news for US-based indian tech workers! A provision permitting spouses of H-1B visa holders to work in the US has been upheld by an appeals court. A panel of three judges from the US court of Appeals for the district of Columbia Circuit rendered this ruling. They upheld the obama administration's regulation by rejecting a lawsuit by Save Jobs USA, a nonprofit that advocates for tech workers who were born in the US. Under President obama, the Department of Homeland Security (DHS) implemented a regulation in 2015 that permits some spouses of people with H-1B visas to work in the United States.
Save Jobs USA contended that this regulation was unjust and endangered US employment. Notwithstanding, the court maintained the regulation, asserting that DHS had the jurisdiction to execute it, citing other rulings that bolstered analogous regulations. They contend that permitting H-4 spouses to work will motivate H-1B employees to apply for permanent residence, preserving the US IT industry's inventiveness and competitiveness. Given that many of the top employers for H-1B visas are indian outsourcing companies, this decision is very important for qualified indian workers.
