The delhi high court said that the trial court will continue hearing the case, there will be no stay on the proceedings in the lower court. The court has issued a notice on Kapil Mishra's petition. The high court said that the court is not in favor of staying the hearing at the moment.

Kapil Mishra's lawyer said that the FIR was registered without following the provisions and procedure given in the CrPC. The X post was not done deliberately to hurt anyone's sentiments. Lower court refused to cancel the proceedings
