According to the new law, a committee consisting of the prime minister, a minister appointed by the prime minister and the leader of the Opposition in the lok sabha will select the election Commissioner. The Chief election Commissioner and the three-member committee to select the election Commissioners previously included the Chief Justice of the supreme Court. But the central government passed a new law removing the Chief Justice. Accordingly, the committee to select the election Commissioners will include the prime minister, the Union minister and the leader of the Opposition in the Lok Sabha.
According to this procedure, a high-level committee comprising Union Law minister Arjun ram Maghwal, Union home Secretary, Union Personnel Department and others will hold a consultation and recommend the names of 5 persons each to the central government for the 2 posts. Subsequently, a three-member committee consisting of the prime minister, the Union minister and the leader of the Opposition in the lok sabha will finalize the names of two of the five nominees. Later, an official decree in this regard will be issued by President Draupadi Murmu. Accordingly, the committee to select the election Commissioners will include the prime minister, the Union minister and the leader of the Opposition in the Lok Sabha.
