A bench comprising Justices Manindra Mohan Srivatsava and Ashutosh Kumar said that the Chief Minister's allegations were against the judiciary as a whole and appeared to defame the courts. According to the petition filed by lawyer Shiv saran Gupta, it has been alleged that ashok gehlot had spoken about corruption in the judiciary on august 30 and that was deliberately defaming the judiciary.


In his plea, Shiv saran Gupta has also sought the high court to take up the matter on its own initiative in exercise of the court's jurisdiction under Article 215 of the Constitution of India. Khelat alleged widespread corruption in the judiciary, including higher judicial institutions. Speaking at a recent press conference, ashok Khelat said, "Corruption is happening within the judiciary today. It is very appalling. I have heard a lot of lawyers write judgments and take them to court. That is what is being pronounced in court."
