OTT Law - Adult Scenes Ok, But Not Tobacco

According to official sources, anti-tobacco warnings and disclaimers similar to those shown in films and television shows may soon be required for Over-the-Top (OTT) platforms. According to sources, OTT platforms will be required to air anti-tobacco health commercials for at least 30 seconds at the beginning and middle of any programming that features tobacco products or their usage.
When tobacco products are exhibited, a clear static notice warning about the health dangers of tobacco use shall also appear at the bottom of the screen. Additionally, a 20-second audio-visual disclaimer about the negative consequences of tobacco use should appear at the beginning and midway of the programme. Strangely, smoking cigarettes is causing the health ministry concern yet excessive violence, disgusting sex scenes, and vulgar language are allowed without any censoring in web series.

Violence and obscenity may have a far worse impact on India's young brains than simply showing someone smoking a cigarette. On november 9, 2020, the indian government published a gazette notice with President Kovind's signature placing online films, television shows, and news and current affairs content under the purview of the Ministry of Information and Broadcasting (MIB).
Netflix, Hotstar, amazon Prime Video, ALT Balaji, and other Over The Top (OTT) video streaming services were previously governed by the Ministry of Electronics and Information technology (MeitY).
