Nani Palkhiwala: How would you decide where you were born?


When the ayodhya case made it all the way to the supreme court in 1993, renowned attorney nani Palkhiwala became involved. Following Babri's demolition, the Center has asked the supreme court for recommendations on Janmabhoomi.

Palkhiwala advised Justice Venketchalaiah that he would be unable to administer justice in the case and that, therefore, he should decline to hear it. Palkhiwala gave four explanations in support of this.

1. Based on their education and expertise, courts are not equipped to consider birthplace disputes. He is limited to hearing cases involving facts or legal issues.

2. Since this is a political matter, his standing and reputation will suffer if the court holds hearings on it. The public would believe that the ayodhya issue has been concealed by the court.

3. The Center possesses the authority to overturn your choice. Your choice is not required to be accepted by the Center. Only one noisy party will gain from this in such a scenario.

4. A large number of Hindu leaders have questioned the court. The head of the opposition has made it apparent how the court cannot determine the location of the temple's construction. This implies that the commotion won't end if you don't rule in his favor.
