SP mp Ziaur rahman Bark has challenged the FIR in the allahabad High Court. He has filed a petition requesting the cancellation of the FIR. Along with this, he has demanded a stay on the arrest till the final decision of the court comes. Bark's petition states that he was not in Uttar Pradesh on the day of sambhal violence on 24 November. He had gone to Bengaluru to attend a program. Even after returning to Bengaluru, he had appealed to the people to maintain peace. The police have filed a fake FIR against him only due to political pressure.
