'Get encroachment on roads cleared by farmers', PIL filed in SC
A petition has been filed in the supreme court demanding the opening of the Shambhu data-border between Haryana-Punjab and other highways of Punjab. A bench headed by Justice surya Kant will hear it on Monday, 9 December. The petitioner has said that the Shambhu data-border has been closed for a long time due to the farmers' agitation. Now the farmers unions have also closed other highways of Punjab. This is not only illegal, but also a violation of the fundamental rights of other citizens.
petitioner Gaurav Luthra, a resident of Jalandhar, punjab, has said that obstructing the road is a crime under the BNS (Indian Justice Code) and NHAI Act. But neither the police nor the NHAI (National Highway Authority) is taking any action. The Constitution also gives the right to movement the status of a fundamental right. This fundamental right has been taken away from a large population of Punjab. The petition demands that the supreme court ask the central and state governments to open all the roads.
supreme court formed a high powered committee
It is worth noting that on september 2, while hearing another petition on the same issue, the supreme court formed a 5-member high powered committee under the leadership of former punjab and haryana High court judge Justice Nawab Singh. The committee was asked to talk to the farmers on MSP and other issues. The court also asked the panel to talk to the farmers to remove the barricading. The supreme court also told the farmers to avoid politicizing their movement. Farmers should not make unreasonable demands in their meetings with the panel.
