Supreme Court dealt a big blow to bribe taking politicians..?

The seven-judge Constitution bench of the supreme court, while hearing the Note for Vote case, unanimously overturned the decision of the five-judge Constitution bench of the supreme court in 1998. In the decision, the court clearly said that if any mla takes bribe and votes in the Rajya Sabha, then a case can be directly filed against him under the 'Prevention of Corruption Act'.

This decision came at a time when on september 20, 2023, the supreme court had taken an important decision and agreed to hear the privilege of legal immunity against the MPs or MLAs involved in the 'bribe for vote' case in the House. That is, after this decision of the court, now MPs and MLAs will not get any kind of legal protection in cases of taking bribes. Earlier in the year 1998, a five-judge bench of the supreme court, while giving its verdict in the case of PV narasimha Rao, had said that MLAs, MPs in the parliament and the Legislature will get legal protection in the case of bribes for their votes and speeches. That means you will be exempted from litigation.
