Now the candidate of Narayan Tripathi’s party to campaign fearlessly
madhya pradesh high court has stayed the order of district Badar of a candidate contesting assembly
elections. This ban will continue till november 20 and during this time the candidate will be able to campaign.
A single bench of Justice vivek Aggarwal gave the petitioner freedom to file an appeal against the order of
the district Magistrate after november 20.
Actually, this whole matter is related to Vindhya Janata party (VJP) candidate Arun Kumar gautam from
Tyonthar assembly seat of Rewa. Advocate Rajmani Mishra presented his case in madhya pradesh High
court on behalf of Rewa resident Arun Gautam. He alleged that the district Magistrate is working as a puppet
in the hands of the ruling party and efforts are being made to stop the candidates from contesting the elections.
He told that the Superintendent of police submitted the report to the collector on october 19 in this many
years old case. The district Magistrate issued a notice to the petitioner on 26 October. After this, the petitioner
appeared in the district Magistrate's court on 3 november and presented his objection. Before this he asked
for the report of the Superintendent of police, but it was not provided to him.
It was told by the government that the order for district Badar has been issued on 7th November. Justice Vivek
Aggarwal said that the statements of the witnesses and the records of their cross-examination should be
shown. On this the government advocate said that the records will have to be called. Expressing strong
displeasure on this, the court said that when advance notice was given in the case, the government advocate
had to appear with the records. The government machinery should also be impartial towards the other party.
The court said that since voting is on 17th november, the district Magistrate's order against the petitioner will
be stayed till 20th November. The single bench of Justice Aggarwal gave the petitioner the freedom to file an
appeal against the order of the district Magistrate after november 20 and directed the Divisional
Commissioner to dispose of the appeal after hearing the appeal.
Let us tell you here that 16 cases have been registered against VJP candidate Arun Kumar gautam alias
Commando (resident of Sonauri police station Sohagi), including assault on a government employee. Apart
from this, 5 cases are also registered in Prayagraj. In view of his criminal record, Sohagi police had proposed
action in district Badar and presented a challan in the collector Court.
