Lakshadweep mp Mohammad Faizal has got a blow from the supreme Court. The supreme court on Tuesday

(August 22) set aside the kerala high court order suspending the conviction and sentence in the attempt to

murder case. Faizal's lok sabha membership was restored only after the order of the High Court. However,

while giving interim relief to Mohammad Faizal, the supreme court has said that the high court should take a

decision in 6 weeks after hearing afresh. Till then the benefits being given to Faizal on the basis of the old

decision will continue.

The bench of Justice BV Nagaratna and Justice Ujjwal Bhuiyan was hearing the matter. The bench, however,

spared the mp from any possibility of disqualification and said that the protection under the earlier order would

continue for six weeks. The high court will have to decide on the new petition of the Lakshadweep

administration during this period. The supreme court said that the kerala High Court's approach in suspending

the conviction and sentence of mp Mohd Faizal in the case was flawed.

What is the whole matter?

On january 11, 2023, Faizal and three others were sentenced to 10 years' rigorous imprisonment by a sessions

court in Kavaratti, Lakshadweep, on charges of attempting to murder Mohammad Salih, son-in-law of late

Union minister PM Sayeed, during the 2009 lok sabha elections. And a fine of one lakh rupees was imposed.

This order was challenged by Faizal in the kerala High Court. On january 25, the high court suspended

Faizal's conviction and sentence.

What did the high court say?


The high court had said in its order that it was suspending the conviction and sentence of the ncp leader till

the disposal of his appeal against the lower court order. It has been said that by not doing so, there will be re-

election on the seat vacated by him, which will put a financial burden on the government and the public.
