For married spouses who want to divorce, there is a six-month waiting period for the uninitiated. After this six-month waiting period, the court will only hear their divorce case. In the present, the supreme court has issued a new ruling stating that marriages may now be dissolved immediately. On Monday, a constitution panel decided that the supreme court might dissolve a marriage immediately, without the usual six-month waiting time.
If the court determines that the couple has suffered irreparable harm and they mutually decide to separate, this will take effect. In this situation, the marriage can be dissolved by the supreme court immediately. According to Article 142 of the Constitution, the court has a unique power over this. The court described this as an order that is required to fully uphold the rights of the parties who have given their permission.
The court first heard the argument to approve this specific order back in 2016. On september 29, 2022, following the hearings, the court reserved its decision. A five-judge panel approved the final judgement today. Most of them have welcomed this decision as this mutual consent divorce can give the couple to find their own lives.
