The situation surrounding arundhati Roy and Dr. Sheikh Showkat Hussain's prosecution under the Unlawful Activities (Prevention) Act (UAPA) revolves around events that occurred during a conference titled "Azadi – The Only Way" in october 2010 at LTG Auditorium, Copernicus Marg, New Delhi. Social activist Sushil Pandit filed a complaint that led to an FIR, alleging that Roy and Hussain delivered provocative speeches advocating for the separation of kashmir from India.
According to the complaint, both individuals allegedly asserted that kashmir was never a legitimate part of india and was forcefully occupied by indian armed forces. The complainant supported these allegations with recordings of the speeches delivered at the conference, which also featured prominent figures like late Hurriyat leader Syed ali Shah Geelani, SAR Geelani, and Varavara Rao.
