The punjab and haryana high court has ruled that Muslim women can marry whomever they wish after attaining puberty, even if they are under 18 years of age. The high court has ruled that under Muslim personal law, a woman under the age of 18 is free to marry whomever she wishes. The high court has issued this order based on the literature on Islamic marriage and various court orders.‘Principles of Mohammedan Law by Sir Dinshah Fardunji Mulla’ has also been produced in the stated judgment. Every Mahomedan of good mind, who has attained puberty, may enter into a contract of marriage, the court was informed. The order was issued by Judge Alka Sarin while hearing a petition filed by a couple from Punjab. A 36-year-old man and a 17-year-old woman from punjab got married on january 21 last year according to Islamic rites.They asked the court to protect their lives and property as their relationship was in danger from relatives. The court was told on behalf of the couple that an adult man and woman have the right to marry without the intervention of others. The judge who heard the case said the Islamic woman was abiding by Islamic personal laws.The judge also said that parents and family members cannot be deprived of their basic rights just because they are married against their will. The judge, therefore, ruled that a Muslim woman has the right to marry whomever she wishes, even if she is under the age of 18.
