After the suicide of 34-year-old Bangalore engineer Atul Subhash, people on social media have started demanding justice for him. Atul Subhash committed suicide after getting fed up with the harassment of his wife and in-laws. Before committing suicide, Atul Subhash left behind a video of about one and a half hours. Along with this, he also left behind a suicide note of 24 pages.

Atul had openly expressed his anguish in the video and the suicide note. On the basis of this, Atul's brother filed a case against Atul's wife and in-laws in Bangalore police for inciting suicide. Case is filed under these sections

In the case of Atul Subhash's suicide, Bengaluru police has filed a case under Section 108 (abetment to suicide) and 3(5) of the indian Penal Code (BS). If someone writes someone's name in a suicide note and goes away, then a case can be filed against him under this section.

If a case is filed under these sections and the allegation is proved against that person, then he may have to data-face up to 10 years in jail and fine. In such a case, the police can arrest anyone without a warrant. And the arrest made in this case is non-bailable.

But if someone commits suicide by writing someone's name in a suicide note, then he cannot be punished only on this basis. For this, first the action is taken under the complete procedure, in which the authenticity of the suicide note is checked. Because it is primary evidence. Therefore, its authenticity has to be verified whether it has been written by the suicide victim. For this, handwriting analysis and examination of the paper and ink of the suicide note is done. Apart from this, a factual investigation of the allegations made in the suicide note is done.
