Guv's refusal to name Ponmudi as a minister...?

Governor RN Ravi's reluctance to appoint K Ponmudi as a minister was contested by the tamil Nadu government on Monday, after the supreme court "suspended" Ponmudi's conviction in an asset-disparity case earlier this month. In its application, the state contested the governor's failure to move forward with bills and appointments, claiming that the governor was "attempting to run a parallel government and is attempting to choose minister as per his subjective assessment of suitability, which is impermissible." The state filed the petition last year.

In front of a bench led by Chief Justice of india (CJI) Dhananjaya Y Chandrachud, senior counsel abhishek Manu Singhvi and p wilson brought up the issue and asked for an urgent listing. "It concerns the same misbehaving governor who was previously dealt with by this court," Singhvi stated, citing the court orders from november and december of last year that objected to the governor's excessive delay in approving ten measures.

Singhvi informed the court that the governor's rejection of a letter Chief minister MK stalin wrote requesting K Ponmudi's sworn in as minister of higher education has prompted the state to reapply to the court. On december 21, 2023, Ponmudi lost his eligibility after the madras high court found him guilty in a disproportionate assets case and sentenced him to three years in prison. However, the conviction order was postponed by the supreme court on march 11, eliminating the restriction on his ability to hold public office under the Representation of Peoples Act. "According to the governor, it is morally wrong for him to appoint the minister," Singhvi stated, adding that a letter had been sent to the Registry requesting an immediate listing. "You circulate the mail," the bench, which also included justices jb Pardiwala and Manoj Misra, commanded. We'll investigate it.
