Many questions related to decisions on Chandigarh Mayor elections?

Fairness of electoral system and electoral process is the backbone of any democratic system. This is directly related to the constitutional rights given to the citizens. Two decisions have come from the supreme Court. The supreme court gave its verdict on electoral bonds on 15 February. In this, the electoral bond scheme brought for political donations was declared unconstitutional. After that, the supreme court passed an order on 20 february regarding the rigging in the chandigarh Mayor elections held on 30 January. In this, the actions of Presiding Officer Anil Masih were considered as misconduct and it was described as an attempt to murder democracy.

Fairness of electoral system is important

In the parliamentary system, political parties exist only under the electoral system. The election process is completed. It is through this process that the form of legislature and government is decided. Considering the importance of elections, a provision for an impartial election commission has been made in our Constitution. There is a provision for a constitutional body like election commission in Part 15 of the Constitution for elections to the Houses of Parliament, rajya sabha and lok sabha as well as State Legislative Assemblies.

This commission also has the responsibility of conducting the elections of the President and Vice President. Along with this, in Part 9 and 9A of the Constitution, provision has been made for State election commission for elections in Panchayats and Municipal Bodies. Both these institutions have the responsibility of ensuring fairness in the elections falling within their respective jurisdictions.
