Why is Uniform Civil Code being opposed?
Muslim organizations have considered the Uniform Civil Code Bill introduced in uttarakhand as a violation of minority rights. The All india Personal Law Board has argued that a Uniform Civil Code would violate several articles of the indian Constitution. Jamiat Ulema-e-Hind says that Uniform Civil Code will harm Hindu-Muslim unity. Jamiat Ulema-e-Hind has also been vocal against the Uniform Civil Code.
According to the proposed bill, Muslims will also not be able to marry more than once without giving divorce. Till now, according to Shariat, Muslims can perform multiple marriages. According to Shariat, the marriageable age of a girl is considered to be the beginning of menstruation, but in the Uniform Civil Code, the marriageable age of a girl is 18 years. Till now any Muslim person could adopt a child, but changes have been made in the Uniform Civil Code regarding this also.
The situation regarding divorce has been clarified in the Uniform Civil Code Bill. Both husband and wife have been given equal rights for divorce. After the implementation of this law, practices like triple talaq, halala and iddat among Muslims will be completely banned. The Uniform Civil Code has also been opposed by the largest organization of Sikhs, SGPC i.e. Shiromani Gurdwara Parbandhak Committee. SGPC says that this will harm the unique identity of minority communities in the country.
