Relationship that doesn't lead to marriage is Not Rape says Supreme Court
The court reached this ruling in regard to a case where a 30-year-old madhya pradesh lady accused her 31-year-old spouse of rape, claiming they had a sexual relationship under the guise of marriage. "You can either live a normal life or one that conforms to your values, which may involve having sexual interactions. If the latter is the case, you cannot appear in court and accuse someone of rape just because you had a failed relationship under the pretense of marriage. The top court stated that this renders a true case of sexual assault and rape inadmissible.
According to the court, many couples in large cities and towns prefer to have physical interactions before being married, and because this is a consensual action, they cannot constantly seek judicial intervention. "You can either live by more traditional standards or select your own lifestyle. Many young people are choose the latter in large cities. There is no issue as long as it is consensual and between adults. However, if you decide to live by your own standards, you need also be prepared to deal with any negative effects that may arise, a bench of justices led by Sanjay Kishan Kaul and Sudhanshu Dhulia said.
