The dream of lakhs of soldiers of Central Paramilitary Forces (CAPF) getting old pension has been shattered at present. On january 11 this year, the central government has taken a stay order from the supreme court till february 2024 on the major decision given by the delhi High court regarding the implementation of the old pension system in CAPFs. The bench of Justice sanjeev Khanna and Justice Bela Trivedi of the supreme court has ordered a stay on the order of the High Court. Solicitor General Tushar Mehta appeared on behalf of the central government in the supreme Court.

delhi High court, in its decision given on january 11, had said that the old pension should be implemented in CAPFs within eight weeks. The central government did not go to the supreme court against the decision of the High court, but sought 12 weeks time from the court. The special thing in this is that in the argument given by the central government before the High court, it did not talk about implementing 'OPS' in 12 weeks. Time was sought only for thinking on this issue.

No old pension to the employees recruited after 2004

Meaning, during this period, the central government can also go to the supreme court against the decision of the delhi High court or can take any other route within the purview of the law. The central government had reserved all these rights with itself in its petition in the High Court. The central government was not ready to recognize the central paramilitary forces as armed forces in many cases. The issue of old pension was also entangled in this affair. After january 1, 2004, all the personnel recruited in central government jobs were excluded from the purview of the old pension.He was included in NPS. CAPFs were also excluded from old pension along with civil employees. At that time the government believed that the army, navy and air force are the only armed forces in the country. It has been said in the BSF Act 1968 that this force was formed as an armed force of the Union of India. Similarly, the rest of the CAPF forces have also been constituted as the Armed Forces of the Union of India
