In this case, the bombay high court has upheld the central government's decision barring a person who obtained Belgian citizenship and traveled to other countries using an indian passport, i.e. passport, from entering India. A division bench comprising Justices gautham Patel and Neela Gokai in its march 14 order denied relief to vikram Shah, who had filed a petition challenging the Centre's decision. He had made an innocent mistake was not accepted but rejected by the court. In his petition, Shah sought direction from the central government to issue a visa to visit india or a Citizenship of india (OCI) card for overseas Indians.
If he (Shah) had traveled on his indian passport even after acquiring Belgian citizenship, it must have been a deliberate and knowing act and could not have been a mistake or negligence. There is no question of violation of any fundamental rights as the petitioner is not a citizen of india and fundamental rights are available only to citizens of india, the bench said. The Union home Ministry told the court that Shah had violated provisions of the Citizenship Act and the Passport Act by using his indian passport to purchase visas to visit other countries on several occasions. Shaw acquired Belgian citizenship in May 2015. But it is noteworthy that his indian passport was not handed over till september 2020.
