In a similar move, the top court permitted former Anil minister Deshmukh and maharashtra minister Nawab Malik, both of whom are currently in jail on charges of money laundering, to be escorted by the CBI/ED to the assembly so they could participate in the floor test. Senior attorney abhishek Manu Singhvi, who represented Prabhu during the hearing on his petition, argued that it would not be appropriate to conduct a floor test while restricting the Speaker's authority. He urged the court to either allow the Speaker to decide the disqualification proceedings or postpone the floor test.

He requested either that the Speaker be permitted to resolve the disqualification procedures or that the hearing in the matter be advanced. He begged the top court to balance the equities and defer the floor test by a week. Senior attorney Neeraj Kishan Kaul argued on behalf of the rebel MLAs that the top court had stated in its rulings that the MLAs' disqualification procedures had no influence on the floor test in the House.

He stressed that "the dance of democracy takes place on the floor of the house" and that "we are the shiv sena and we represent the shiv sena (not the other minority)". He added that there are 39 dissident MLAs, 16 of whom have been sent with disqualification notices. He claimed that the floor test is the most effective means to stop horse trading because the uddhav Thackeray-led shiv sena is a "hopeless minority within the party itself, forget the house."
