In the news is a report from the Law Commission on India's legal consent age for s*xual activity. The Law Commission recommended against lowering the legal age for consensual physical relations in its report. In accordance with the POCSO Act, the commission submitted this report at the request of the home Ministry. The POCSO Act, which was introduced in 2012, raised the legal age for consensual sex from 16 to 18. Later, it received a great deal of criticism, but the government stood firm. The government argued that certain exceptions would not result in the law being changed.Many of these recent cases involved young people who had a love marriage with a minor girl, and the POCSO Act was used to punish them. Numerous courts across the nation have expressed concern about this. Following that, this subject was also brought up in Parliament.Don't lower the age; a child bride is a frail person. According to the Law Commission, which is led by Justice Ruturaj Awasthi, the fundamental rigour of this law must be preserved. Reducing the legal age for sexual activity could increase child marriage and prostitution.The Commission also questioned how a child could be capable of giving consent, especially since India's legal majority age is 18. The international Commission for Protection of Child Rights, former judges, solicitors, child rights advocates, lawyers, NGOs, and subject matter experts were all consulted while the Law Commission was putting together this report. According to the report, the Child marriage Act of 2006 does not completely prevent minors from getting married. It was deemed a weak law by the Law Commission because it didn't address the issue of having s*x with a minor spouse.
