Speaking on Stalin's behalf, Senior Advocate AM Singhvi told the court that, in addition to the previous FIRs in many states, a new complaint had been lodged in Bihar. "You can't keep filing new complaints," the court said sternly in response. Singhvi further reminded the court that it had discussed moving the cases to Karnataka, rather than tamil Nadu, during the last hearing.
Singhvi made the argument that Stalin's comments were less offensive in contrast, citing earlier supreme court decisions in instances comparable to his, such as the Nupur Sharma case. On behalf of the maharashtra government, Solicitor General Tushar Mehta retorted that the comments were made during a "Sanatan dharma eradication conference."
"He said it has to be eradicated... please see if the chief minister of a different state had said something similar about a different religion, such as eradicating islam," he said in his submission. Mehta further noted that the comments were nonetheless objectionable even if the group in issue had not responded violently.
Declaring, "As the apex court, we can't react to comments," the Chief Justice of india (CJI) made it plain that the court would not become involved in the case's merits. In addition to extending the already granted temporary protection, the bench later sent out a notification regarding Stalin's application. Bihar and other states where FIRs have been filed have been permitted to become parties to the lawsuit, and their response has been requested.
The interim ruling prohibiting more cases against stalin will stay in effect until the matter is scheduled for a hearing the week of april 28, 2025.
