Bold Decision Taken on OTTs

A Public Interest Litigation (PIL) that demanded an impartial agency to regulate material on over-the-top (OTT) platforms such as Netflix was dismissed by the supreme court of India. Chief Justice DY Chandrachud led the court in declaring that the government should handle this matter and that it must confer with all relevant parties before taking any action.

The justices pointed out that content regulation entails intricate policy choices that are better left to the government rather than the courts. As a result of this decision, the government must figure out how to control OTT material without compromising the right to free speech and creativity.

Shashank Shekhar Jha, the attorney who filed the PIL, aimed to express worries about the potential for OTT platforms, such as the Kandahar hijacking series, to falsify events. He maintained that OTT platforms function without a comparable supervision authority, but motion pictures in cinemas are examined by a certification board. The freedom of expression guaranteed by the indian Constitution may be abused as a result of this absence of restriction. The petition emphadata-sized the need for regulations to guarantee responsible content development, given that india is home to more than 40 OTT sites.
