Zomato summoned over 'false practice' of food delivery from 'iconic' restaurants
In a civil lawsuit seeking a restraining order against the firm for allowing users to purchase "hot and authentic food" from "iconic restaurants" all throughout the nation's capital, a delhi court has summoned Zomato. The court was hearing a plea from a resident of Gurugram who said zomato was bringing fresh food from popular restaurants under their 'Dilli ke Legends' sub-category, which was a "false and fraudulent" practise.
Civil Judge Umesh Kumar issued an order recently saying, "Issue summons of the suit and notice of application." The plea claims that on october 24 of last year, Sourav Mall placed an order with three different restaurants in Jangpura, Kailash Colony, and Jama Masjid. He then tracked the delivery partner and discovered that the order was picked up from the "unknown and unnamed" location rather than the original restaurant.
Why, when there isn't a restaurant partner branch there, was the meal brought up from a neighbouring location? Why isn't the food being delivered in the restaurant partner's original packaging? What is the guarantee that the meal has been produced by the restaurant partner? How can one be sure that the meal is hot and freshly prepared? said the plea.

It went on to say that Zomato's 30-minute delivery of food from famous delhi eateries to areas like Gurugram and noida was "inexplicable".
The complaint stated, "Such representation to users, customers or patrons of zomato, is indeed intended to deceive the public at large."
Under the Code of Civil Procedure, the plea was filed as a "representative suit" on behalf of many impacted parties (CPC).
On march 20, the case was posted for further action.
